Professional Biography
Simon has been working in Clinical Negligence since 1986 and brought his vast expertise, including being a former Partner at another firm, to Simpson Millar in November 2022. He also spent 2 years acting for the NHS, defending Medical Negligence claims, which gave him an insight as to how the NHS deal with this area of law. With extensive experience in handling claims against both NHS and private healthcare providers, Simon has successfully secured significant compensation for clients affected by medical oversights. His areas of specialisation include amputations, delayed diagnoses and misdiagnosis of cancer, diabetic claims, and ophthalmic claims.
Simon’s daily responsibilities involve comprehensive case management. He begins with taking instructions from clients and thoroughly reviewing medical records. He then proceeds to instruct suitably qualified and experienced medical experts, assesses their reports for viability, and drafts letters of claim. Simon meticulously evaluates responses from defendants, liaises with counsel, and assesses the potential value of claims. His role extends to issuing and serving court proceedings and managing the various steps leading up to a trial. A key aspect of his work involves negotiating settlements to achieve the best possible outcome for his clients.
Simon handled a tragic case involving Mrs X, who passed away in the summer of 2018 after suffering multiple seizures and a failed medical intervention. Mrs X experienced a left temporal bleed due to Arteriovenous Malformation (AVM). Despite undergoing an embolectomy, the delayed administration of aspirin resulted in a fatal thrombosis in her basilar artery. Simon’s dedicated efforts led to an apology and admission of breach of duty from the defendant’s Solicitors, and a £980,000 settlement for Mr X, who was left to care for their four young children. The case was made even more challenging by the language barrier, as Mr X required an interpreter throughout the proceedings.
