Cases Dealt With
This case dealt with the approach taken by the court in circumstances where a close family member living in P’s home repeatedly interfered adversely with the care provision provided to ‘P’ via a care package which was delivered by a wider team of carers and professionals. The conflict relating to the provision of care led to a ‘toxic’ atmosphere within which the neurorehabilitation of ‘P’ fell short and was described in the judgement as ‘suboptimal’. The care package was considered at risk of breaking down which would lead to ‘P’ being placed in residential care. In balancing all factors, including P’s love for his mother, the court made a declaration that it was not in P’s best interests for his mother to continue living in his home and she was required to find alternative accomoodation.
Kevin is a member of the Law Society Panel for Court of Protection practitioners. He is also an Accredited Legal Representative.
Kevin is a keen amateur dramatist and has often been found treading the boards at Wigan Little Theatre. He’s also a keen sports follower, mostly rugby, and enjoys gardening, travelling and spending time with his wife and two dogs.
